These Terms & Conditions govern all safaris, trips, cruises, extensions, custom itineraries, activities, transfers, accommodation, guiding, air arrangements, and related travel services arranged by IntelSafari. They form part of your traveler contract together with your itinerary, proposal, invoice, confirmation, and any written special conditions issued by IntelSafari.

By requesting a booking, making any payment, signing a travel document, or participating in a trip arranged by IntelSafari, you agree to these Terms & Conditions for yourself and for every traveler included in your booking.

Important: For readability, operational links and client reference links are listed separately at the end of this document. Those links are provided for convenience and do not replace the terms below.

1. Definitions

  • “Client,” “traveler,” “you,” and “your” mean the lead traveler and every person included in the booking.
  • “Booking Date” means the date IntelSafari issues written confirmation or an invoice for your trip.
  • “Departure Date” means the first date on which services under your trip are scheduled to begin.
  • “Trip” means any safari, tour, cruise, extension, itinerary, activity, transfer, accommodation, flight, or related service arranged by IntelSafari.
  • “Supplier” means any independent third party providing services for your trip, including lodges, camps, hotels, airlines, cruise lines, charter operators, transfer companies, guides, park authorities, activity operators, and destination partners.
  • “Unrecoverable Costs” means costs that IntelSafari cannot recover from suppliers, including but not limited to permits, flights, special-event tickets, charter services, deposits, single supplements, room blocks, cruise fares, and other prepaid or non-refundable services.
  • “Force Majeure” means circumstances beyond IntelSafari’s reasonable control, including natural disasters, disease outbreaks, epidemics, pandemics, government actions, border closures, airline disruption, supplier failure, strikes, war, civil unrest, terrorism, severe weather, wildlife or environmental events, and any other comparable event beyond our control.

2. Role of IntelSafari

IntelSafari designs, advises on, coordinates, and arranges travel experiences. We act as an organizer and intermediary for many travel components that are delivered by independent suppliers. Each supplier is responsible for its own services, operations, safety standards, employees, equipment, vehicles, property, and acts or omissions.

IntelSafari exercises reasonable care in selecting suppliers and planning itineraries. However, we do not own or control every lodge, camp, aircraft, vehicle, cruise ship, permit office, park authority, or activity provider involved in your trip. Supplier terms may apply in addition to these Terms & Conditions.

3. Quotes, Pricing, and Availability

  • Quoted prices are usually per person and based on double occupancy unless your proposal or invoice states otherwise.
  • Prices may be shown in U.S. dollars or another currency stated on your invoice.
  • Prices are subject to availability until deposit payment and written confirmation are completed.
  • Prices may change before confirmation due to exchange rates, park fees, fuel costs, government taxes, supplier rate changes, airline fares, cruise fares, permit costs, or other external charges.
  • After confirmation, IntelSafari will try to absorb minor supplier changes where practical; however, material increases beyond our control may be passed to the client with written notice.
  • Promotional offers, discounts, and limited-time savings apply only according to the stated promotion dates, eligible trips, and booking conditions.

4. What Is Included and Not Included

Your itinerary and invoice determine what is included in your specific trip. Unless expressly listed as included, a service should be treated as excluded.

  • Excess baggage charges
  • Meals or transfers caused by flight changes, delays, missed connections, or schedule disruptions
  • Any item not expressly listed as included

5. Booking, Deposit, and Final Payment

A booking is not confirmed until IntelSafari receives the required deposit and issues written confirmation or an invoice. Space may be released if payment is not received by the stated deadline.

Deposit

A non-refundable deposit of 25% of the total trip cost is due at the time of booking unless a different deposit is stated on your invoice or required by a supplier. Certain services may require higher or immediate non-refundable deposits, including gorilla permits, chimpanzee permits, flights, cruises, private villas, exclusive-use camps, special-event services, and peak-season room blocks.

Final payment

Final payment is due 60 days before the Departure Date unless your invoice states a different deadline. Bookings made within 60 days of departure may require full payment at the time of confirmation.

Late payment or non-payment

If final payment is not received by the due date, IntelSafari may treat the booking as cancelled by the client. Applicable cancellation fees and unrecoverable supplier costs will apply.

Payment methods and transaction costs

Accepted payment methods will be stated on your invoice or payment instructions. The client is responsible for bank fees, card processing fees, wire transfer fees, foreign exchange costs, intermediary bank charges, and any shortfall caused by currency conversion or payment processing.

6. Client Information, Names, and Special Requests

You must provide accurate legal names exactly as shown on each traveler’s passport. You are responsible for confirming that names, birth dates, passport details, flight details, rooming details, and other personal information are correct before tickets, permits, and supplier services are issued.

Special requests, including dietary needs, allergies, medical conditions, mobility needs, bedding preferences, room location, adjoining rooms, celebrations, and accessibility requirements, must be disclosed before booking. IntelSafari will communicate reasonable requests to suppliers but cannot guarantee fulfillment unless confirmed in writing.

7. Client Changes After Confirmation

IntelSafari will try to accommodate reasonable client-requested changes after confirmation. Changes may be subject to availability, supplier approval, price differences, administration costs, permit reissue costs, airfare penalties, cruise penalties, and other supplier fees.

Changes requested within the cancellation period may be treated as a cancellation and rebooking. A change is not confirmed until IntelSafari confirms it in writing and any required additional payment is received.

8. Client Cancellation and Refunds

Cancellation must be sent in writing to info@intelsafari.com by the lead traveler. Cancellation is effective only when IntelSafari acknowledges receipt in writing. The following standard cancellation schedule applies unless your invoice, proposal, or supplier terms state stricter conditions.

Unrecoverable Costs are non-refundable and may be deducted from any refund or credit. These may include flights, permits, cruises, special-event services, accommodation deposits, single supplements, room blocks, private charters, and supplier cancellation penalties.

After travel has started, no refund is available for unused services, missed nights, missed activities, voluntary itinerary changes, early departure, denied boarding, late arrival, illness, weather disruption, wildlife movement, or services missed because of traveler action or inaction.

Approved refunds will be returned to the original payment method where possible and are normally processed within 30 days after approval, subject to supplier recovery timelines and third-party payment processing rules.

9. Cancellation or Changes by IntelSafari

IntelSafari may change or cancel a trip when required for safety, operational, logistical, supplier, environmental, governmental, or Force Majeure reasons. We will notify you as soon as reasonably practical and will try to provide suitable alternatives where available.

If IntelSafari cancels a trip before departure for reasons other than Force Majeure, supplier failure, client breach, or non-payment, you may choose one of the following options, subject to unrecoverable costs:

  • A refund of recoverable monies paid to IntelSafari; or
  • A future travel credit of 110% of eligible recoverable monies, valid for 24 months on IntelSafari trips.

If a significant pre-departure change materially affects the trip, such as a major routing change or substantial accommodation downgrade, you may accept the change, select a substitute trip and pay or receive any price difference, or cancel under the applicable terms stated above.

If changes occur after departure, any refund or credit will be calculated on a reasonable pro-rata basis for unused recoverable services, less unrecoverable costs and supplier charges.

10. Force Majeure

IntelSafari is not liable for failure, delay, cancellation, rerouting, additional costs, inconvenience, loss, injury, or disappointment caused by Force Majeure. In such cases, IntelSafari will provide reasonable assistance where practical and will seek recoveries or credits from suppliers when possible. Any refund, credit, or replacement service will depend on amounts recoverable from suppliers and the circumstances of the event.

Clients are responsible for additional costs arising from Force Majeure, including accommodation, meals, transport, medical care, evacuation, flight changes, testing, quarantine, border requirements, and other expenses not included in the original itinerary.

11. Travel Insurance

Comprehensive travel insurance is strongly recommended for every traveler and may be required for certain trips, destinations, activities, or supplier services. Insurance should include trip cancellation, trip interruption, emergency medical treatment, emergency evacuation, repatriation, baggage, travel delay, missed connection, supplier insolvency where available, and coverage for high-value safari, trekking, cruise, or remote-area travel.

IntelSafari may request proof of insurance before departure. Failure to carry adequate insurance is at the traveler’s own risk. IntelSafari is not responsible for expenses that would have been covered by appropriate insurance.

12. Passports, Visas, Health, and Travel Documents

Each traveler is responsible for obtaining and carrying valid passports, visas, permits, vaccination documents, health documents, travel authorizations, entry forms, exit forms, parental consent documents for minors, and any other documents required for the countries visited or transited.

Passports should normally be valid for at least six months after the final date of travel and should contain enough blank pages for entry and exit stamps. Entry requirements can change without notice. IntelSafari may provide general guidance, but final responsibility remains with the traveler.

Travelers are responsible for checking official travel advisories, health requirements, vaccination recommendations, and destination rules before departure and during travel.

13. Health, Fitness, and Medical Care

Safari, trekking, cruise, and remote-area travel may involve uneven terrain, heat, dust, altitude, wildlife, water-based activities, long drives, small aircraft, limited medical facilities, and variable standards of care. You must be medically and physically fit for your chosen trip.

You must disclose relevant medical conditions, allergies, pregnancy, mobility limitations, dietary needs, disabilities, and other conditions that may affect your safety or the safe operation of the trip. IntelSafari may decline, modify, or require additional arrangements for a traveler where safety or operational concerns exist.

Medical treatment, evacuation, medication, hospitalization, quarantine, and related costs are the traveler’s responsibility.

14. Assumption of Risk and Safari Conditions

Wildlife and adventure travel carry inherent risks. These include close proximity to wild animals, remote locations, road conditions, weather changes, insects, illness, altitude, water conditions, aircraft operations, vehicle movement, and other hazards. By booking and traveling, you voluntarily accept these risks.

You must follow instructions from guides, pilots, drivers, park officials, lodge staff, cruise staff, and activity leaders. IntelSafari may remove or restrict a traveler from an activity or trip if the traveler creates a safety concern, disrupts the experience, ignores instructions, or behaves unlawfully or abusively. No refund is due in such circumstances.

15. Wildlife, Seasons, and Itinerary Descriptions

Wildlife sightings, migration movement, river crossings, weather, water levels, road conditions, and natural phenomena cannot be guaranteed. IntelSafari uses destination knowledge and seasonal planning to improve the quality of the experience, but nature remains unpredictable.

Images, videos, maps, route descriptions, lodge descriptions, travel times, wildlife references, and seasonal notes are illustrative and may vary by time of year, weather, supplier changes, local conditions, and conservation rules.

16. Air Travel, Flights, and Baggage

Airlines, charter operators, and local carriers set their own schedules, baggage limits, check-in rules, seating rules, cancellation terms, and liability limits. Flight times and aircraft may change without notice. IntelSafari is not responsible for airline delays, cancellations, overbooking, missed connections, schedule changes, baggage loss, or denied boarding.

Many safari flights require soft-sided luggage and strict weight limits. Travelers are responsible for complying with baggage rules. Additional storage, excess baggage, freight, or private charter costs are the traveler’s responsibility unless stated otherwise in writing.

17. Supplier Terms

Supplier terms apply to services provided by airlines, cruise lines, lodges, camps, hotels, parks, permit offices, activity operators, transport providers, charter operators, guides, and other third parties. Supplier terms may include stricter deposit, cancellation, refund, baggage, liability, check-in, health, safety, and conduct rules.

If supplier terms conflict with these Terms & Conditions, the stricter or more specific supplier rule may apply to that service. Refunds and credits are limited to amounts IntelSafari can recover from suppliers, except where applicable law requires otherwise.

18. Baggage, Valuables, and Personal Property

Travelers are responsible for their baggage, travel documents, electronics, cash, jewelry, medication, photographic equipment, and personal property. IntelSafari is not responsible for loss, theft, delay, or damage to personal property except where required by law.

High-value items should be carried personally and insured. Do not pack medication, passports, essential documents, valuables, or fragile items in checked or stored luggage.

19. Complaints and Claims

If a problem occurs during travel, notify your guide, host, lodge manager, supplier, or IntelSafari contact immediately so we can attempt to resolve the matter while you are still traveling. Failure to report an issue during the trip may limit our ability to investigate or remedy it.

Any post-trip claim must be submitted in writing to info@intelsafari.com within 30 days after your return. The claim should include booking details, dates, a clear description of the issue, supporting documents, and any supplier communication. Claims submitted after 30 days may be declined or limited if the delay affects our ability to investigate.

20. Conduct, Legal Compliance, and Responsible Travel

Travelers must comply with local laws, customs, conservation rules, park regulations, supplier rules, wildlife-viewing rules, and instructions from authorized personnel. Illegal activity, harassment, abusive conduct, unsafe behavior, damage to property, wildlife interference, or conduct that disrupts others may result in removal from the trip without refund.

IntelSafari supports responsible travel, conservation, cultural respect, and fair treatment of local communities. Travelers are expected to act with courtesy toward guides, staff, communities, wildlife, and fellow travelers.

21. Photography, Testimonials, and Likeness

If you share photos, videos, testimonials, reviews, social media tags, or written feedback with IntelSafari, you grant IntelSafari a non-exclusive, royalty-free permission to use that material for editorial, marketing, website, social media, and promotional purposes, unless you opt out in writing before sharing the material.

IntelSafari will not knowingly use sensitive personal information or private images in a misleading way. You are responsible for ensuring that any material you provide does not infringe another person’s rights.

22. Privacy and Data Sharing

IntelSafari collects and uses personal information to design, quote, book, operate, support, and improve travel services. This may include names, contact details, passport information, dates of birth, dietary needs, health or mobility information relevant to travel, payment records, emergency contacts, and travel preferences.

To operate your trip, IntelSafari may share necessary information with suppliers, destination partners, immigration authorities, airlines, insurers, emergency responders, payment processors, technology providers, and professional advisers. IntelSafari handles personal information according to its Privacy Statement & Security page, listed in the Client Resource Links section.

23. Website Terms, Digital Communications, and DMCA

Use of the IntelSafari website may be subject to website terms, privacy notices, cookie or tracking technologies, security rules, reCAPTCHA, and other digital service terms. Website links are listed separately at the end of this document for reference.

If you believe content hosted by IntelSafari infringes copyright, you may submit a notice under applicable copyright procedures. IntelSafari may remove or restrict content where appropriate and may process counter-notices when legally permitted.

24. Responsibility, Limitation of Liability, and Indemnity

To the fullest extent permitted by law, IntelSafari’s aggregate liability is limited to the greater of: (i) the amount paid to IntelSafari for the specific portion of services giving rise to the claim; or (ii) USD $1,000.

IntelSafari is not liable for indirect, incidental, special, punitive, exemplary, or consequential losses, including lost enjoyment, emotional distress, lost opportunity, additional travel costs, missed connections, lost profits, or loss of use, except where such limitation is prohibited by law.

IntelSafari is not liable for acts or omissions of independent suppliers, Force Majeure events, government action, traveler misconduct, failure to obtain documents, airline disruption, illness, weather, wildlife movement, border issues, or events beyond our reasonable control.

You agree to indemnify and hold IntelSafari harmless from claims, losses, damages, penalties, and reasonable legal fees arising from your breach of these Terms & Conditions, negligent or willful conduct, violation of law, damage to property, injury to others, or infringement of third-party rights.

25. Governing Law, Arbitration, Venue, and Class Action Waiver

These Terms & Conditions are governed by U.S. federal law and the laws of the State of New Mexico, U.S.A., without regard to conflict-of-law rules.

Except for eligible small-claims matters, any dispute arising from or relating to these Terms & Conditions, a booking, a trip, or services arranged by IntelSafari shall be resolved by final and binding arbitration on an individual basis under the American Arbitration Association Consumer Arbitration Rules before a single neutral arbitrator.

Proceedings may be conducted by telephone, videoconference, written submission, or another remote method unless the arbitrator determines that an in-person hearing is required. Any in-person hearing will take place in Bernalillo County, New Mexico. Class actions, class arbitrations, and representative proceedings are waived to the fullest extent permitted by law.

Nothing in this section prevents either party from seeking relief in small claims court where permitted or from raising concerns with a government agency.

26. Miscellaneous

  • Entire Agreement: These Terms & Conditions, your itinerary, invoice, confirmation, and written special conditions form the traveler contract.
  • Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
  • No Waiver: A delay or failure to enforce a right does not waive that right.
  • Assignment: You may not assign a booking or rights under these Terms & Conditions without IntelSafari’s written consent. IntelSafari may assign rights or obligations where permitted by law.
  • Headings: Headings are for convenience only and do not affect interpretation.
  • Updates: IntelSafari may update these Terms & Conditions from time to time. The version applicable to your booking is the version provided or referenced at the time of confirmation unless a later version is expressly agreed in writing.
  • Notices: Unless another address is stated in your travel documents, written notices to IntelSafari should be sent to info@intelsafari.com.
