These Terms & Conditions (“T&Cs”) govern bookings and participation in trips, safaris, extensions, and related services arranged by IntelSafari (each a “Trip”). They form your traveler contract together with your itinerary, invoice, and any written special conditions provided by IntelSafari. They operate alongside our Privacy Statement & Security and other applicable website policies.
By making any payment or participating in a Trip, you confirm that you have read, understood, and accepted these T&Cs for yourself and every traveler included in your booking.
1) Definitions
“Client,” “you,” or “your” means the lead traveler and every person included in the booking.
“Booking Date” means the date IntelSafari issues written booking confirmation or an invoice.
“Departure Date” means the first date on which services included in the Trip are scheduled to begin.
“Supplier” means an independent third party providing services, including lodges, camps, airlines, charter companies, transfer firms, guides, activity operators, and permit authorities.
“Unrecoverable Costs” means amounts that are non-refundable or non-creditable to IntelSafari under Supplier terms, including airfare, permits, special-event fees, and specially ordered services.
“Force Majeure” means an event outside the reasonable control of the affected party, including natural disasters, epidemics, government actions, border closures, civil unrest, strikes, severe weather, or similar events.
2) Scope and Role of IntelSafari
IntelSafari plans and arranges Trips and contracts with Suppliers as an intermediary. Suppliers are independent businesses responsible for their own acts and omissions. Subject to applicable law, IntelSafari is not responsible for Supplier negligence or events beyond IntelSafari’s reasonable control.
3) Quotes, Pricing, Inclusions, and Exclusions
Prices are generally quoted per person, based on double occupancy unless otherwise stated, and may be shown in U.S. dollars or another currency specified on the invoice.
Included services are those expressly listed in the itinerary or invoice, such as specified accommodations, scheduled ground transfers, guiding, activities, listed park fees, listed meals, baggage handling, and taxes where indicated.
Unless expressly included, prices exclude international or regional airfare, unscheduled transfers, visas, vaccinations, medical expenses, travel insurance, gratuities, beverages, personal expenses, optional activities, upgrades, laundry, excess baggage, and any other item not specifically listed as included.
Prices may change before full payment because of exchange-rate movements, government taxes, park fees, fuel costs, Supplier increases, or itinerary changes. IntelSafari will communicate material adjustments before they are charged.
4) Booking, Deposit, and Final Payment
- a) Deposit: A deposit in the amount stated on the invoice is due at booking to secure space. Unless the invoice expressly states otherwise, the deposit is non-refundable because IntelSafari may immediately commit funds to Suppliers.
- b) Final Payment: Full payment of the remaining Trip balance must be received no later than 60 calendar days before the Departure Date, unless an earlier deadline is stated on the invoice because of Supplier requirements.
- c) Bookings Within 60 Days: For a booking made 60 days or fewer before the Departure Date, the full Trip price is due immediately upon confirmation unless IntelSafari agrees otherwise in writing.
- d) Late or Non-Payment: If full payment is not received by the applicable deadline, IntelSafari may cancel the booking and apply the cancellation terms in Section 7.
- e) Payment Methods and Fees: Payment methods will be stated on the invoice. The Client is responsible for bank, card, transfer, and currency-conversion fees unless IntelSafari confirms otherwise in writing.
5) Client Changes After Confirmation
IntelSafari will make reasonable efforts to accommodate requested changes to dates, room types, names, routing, or extensions. Supplier change fees and price differences may apply. A change that materially alters or removes confirmed services, particularly within a cancellation period, may be treated as a cancellation under Section 7.
6) Names, Travel Documents, and Special Requests
The Client must provide each traveler’s full legal name exactly as shown on the passport and must disclose dietary, mobility, medical, bedding, and rooming requests as early as possible. IntelSafari will relay special requests to Suppliers but cannot guarantee that every request will be fulfilled.
7) Client Cancellation and Refunds
A cancellation must be submitted in writing to info@intelsafari.com from the lead traveler’s email address. Cancellation becomes effective when IntelSafari acknowledges it in writing.
Standard Cancellation Schedule (unless the invoice or a Supplier-specific written condition states otherwise):

Unrecoverable Costs, including flights, permits, special events, single supplements, and specially ordered services, are non-refundable and may be deducted from any refund otherwise due.
No refund is provided after travel begins for missed, declined, or unused accommodation, transportation, meals, activities, flights, permits, or other services.
Approved refunds will normally be returned to the original payment method within 30 days after IntelSafari confirms the refundable amount, less any third-party processing or transfer fees.
Where a Supplier’s cancellation terms are stricter than this standard schedule and were disclosed in the itinerary, invoice, quotation, or booking communication, the stricter Supplier terms will apply to the affected service.
Travel insurance is strongly recommended and may be required for certain destinations or Trips. Coverage should include trip cancellation, interruption, emergency medical care, and evacuation.
8) Cancellation or Changes by IntelSafari
IntelSafari may modify or cancel a Trip when reasonably necessary for safety, operational, logistical, legal, or Supplier-related reasons.
Before departure, where cancellation is not caused by Force Majeure or Client breach, the Client may choose a refund of recoverable amounts paid or an available future travel credit, subject to Unrecoverable Costs and Supplier terms.
For a significant pre-departure change, the Client may accept the revised arrangements, select an available substitute Trip and pay any price difference, or cancel under the option described above.
After departure, any refund or credit will be limited to recoverable amounts for unused services, less Unrecoverable Costs.
During Force Majeure, IntelSafari will provide reasonable assistance and seek refunds or credits from Suppliers where possible, but cannot guarantee recovery of funds already paid or committed.
9) Health, Fitness, and Assumption of Risk
Wildlife and remote-area travel involves inherent risks, including difficult terrain, severe weather, wildlife encounters, remoteness, limited medical facilities, and transportation hazards. Each traveler accepts these risks, must be fit for the planned activities, must follow safety instructions, and must disclose relevant health or mobility conditions before booking. IntelSafari may decline or discontinue participation where a condition or conduct creates a material safety or operational concern.
10) Passports, Visas, Health Rules, and Travel Advisories
Each traveler is responsible for passports, visas, permits, vaccinations, health documentation, and compliance with entry, exit, customs, and immigration rules. IntelSafari recommends reviewing official travel and health advisories before departure.

11) Baggage, Personal Effects, and Valuables
Airlines and local carriers may impose strict baggage limits. Travelers are responsible for complying with those limits and safeguarding passports, money, electronics, jewelry, and other valuables. IntelSafari is not responsible for loss, delay, theft, or damage to baggage or personal effects except where required by applicable law.
12) Wildlife, Seasons, and Photography
Wildlife sightings, migrations, weather, road conditions, and natural events cannot be guaranteed. Photographs, maps, descriptions, and timing guidance are illustrative and may differ from actual conditions. IntelSafari may adjust routes or activities to improve safety or the quality of the experience.
13) Supplier Terms
Supplier terms apply to the services each Supplier provides and may control where they are stricter or legally required. Copies may be provided upon request. Any refund or credit related to a Supplier service is limited to the amount IntelSafari can recover from that Supplier, subject to these T&Cs and applicable law.
14) Responsibility, Limitation of Liability, and Indemnity
To the fullest extent permitted by applicable law:
IntelSafari’s aggregate liability is limited to the greater of the amount paid to IntelSafari for the portion of services giving rise to the claim or USD $1,000.
IntelSafari is not liable for indirect, incidental, special, punitive, or consequential losses, including loss of enjoyment, missed connections, loss of income, or additional travel costs, or for events beyond IntelSafari’s reasonable control.
The Client agrees to indemnify and hold IntelSafari harmless from claims, losses, and reasonable legal expenses arising from the Client’s breach of these T&Cs, willful misconduct, or negligent acts, subject to applicable law.
15) Travel Insurance and Medical Care
Comprehensive travel insurance is strongly recommended and may be mandatory for certain Trips or destinations. Coverage should include cancellation, interruption, emergency medical treatment, evacuation, repatriation, baggage, and Supplier default where available. Medical facilities and standards vary by destination, and all medical and evacuation costs are the traveler’s responsibility.
16) Complaints and Claims
A traveler should report a problem immediately to the guide, host, Supplier, or IntelSafari so that reasonable efforts can be made to resolve it during the Trip. A post-Trip complaint or claim must be submitted in writing to info@intelsafari.com within 30 calendar days after the traveler’s return. Delayed notice may impair IntelSafari’s ability to investigate or provide an effective remedy.
17) Photographs, Testimonials, and Likeness
Where legally permitted, and unless a traveler opts out in writing before departure, the traveler grants IntelSafari a non-exclusive, worldwide, royalty-free license to use photographs, video, or testimonials voluntarily shared with IntelSafari or posted using IntelSafari identifiers for editorial and promotional purposes. IntelSafari will not knowingly use material in a misleading or unlawful manner.
18) Privacy
IntelSafari processes personal information in accordance with its Privacy Statement & Security. Trip arrangements may require IntelSafari to share relevant information with Suppliers, payment processors, insurers, emergency providers, and government or border authorities. Applicable privacy rights may vary by jurisdiction.
19) Governing Law, Arbitration, Venue, and Class-Action Waiver
These T&Cs are governed by applicable U.S. federal law and the laws of the State of New Mexico, without regard to conflict-of-law principles.
Except for matters eligible for small-claims court, a dispute arising from these T&Cs or a Trip will be resolved through final, binding arbitration on an individual basis under the American Arbitration Association Consumer Arbitration Rules before one neutral arbitrator. Hearings may occur by telephone or videoconference unless an in-person hearing is required; an in-person hearing will take place in Bernalillo County, New Mexico. Class actions and class arbitrations are waived to the extent permitted by law.

Nothing in this section prevents a traveler from raising a matter with an appropriate government agency or exercising a non-waivable statutory right.
20) Copyright and User-Submitted Materials
A person who believes that content hosted by IntelSafari infringes copyright may submit a notice under the U.S. Digital Millennium Copyright Act, 17 U.S.C. §512, using the contact information provided on IntelSafari’s Privacy Statement & Security page. Counter-notices may be submitted where legally applicable.
21) Miscellaneous
Entire Agreement: These T&Cs, the itinerary, invoice, and written special conditions constitute the traveler contract for the Trip.
Order of Precedence: A written special condition or Supplier-specific term stated on an invoice or itinerary controls only to the extent it expressly differs from these standard T&Cs.
Severability: If any provision is held invalid or unenforceable, the remaining provisions remain effective.
No Waiver: A failure to enforce a provision does not waive the right to enforce it later.
Assignment: The Client may not assign a booking or rights under these T&Cs without IntelSafari’s written consent. IntelSafari may assign its rights as permitted by law.
Notices: Formal notices must be sent to info@intelsafari.com unless another address is specified in the booking documents.
