These Terms & Conditions (“T&Cs”) govern bookings and participation in trips, safaris, extensions, and related services arranged by IntelSafari (each a “Trip”). They form your traveler contract in addition to any itinerary, invoice, or written special conditions we provide, and operate alongside our website Terms of Service and Privacy Policy.

By making any payment or traveling on a Trip, you agree to these T&Cs for yourself and everyone you book.

1) Definitions

  • “Client,” “you,” “your”: the lead traveler and all persons on the booking.
  • “Booking Date”: the date we issue written confirmation/invoice.
  • “Departure Date”: first date services under the Trip are due to commence.
  • “Supplier”: independent third parties (lodges, camps, airlines, transfer firms, activity operators, etc.).
  • “Unrecoverable Costs”: supplier costs that are non-refundable/non-creditable to IntelSafari under supplier contracts (e.g., flights, permits).
  • “Force Majeure”: events beyond reasonable control (e.g., natural disasters, epidemics, government action, civil unrest, strikes, severe weather, etc.).

2) Scope & Role of IntelSafari

IntelSafari plans and arranges Trips and contracts with Suppliers as an intermediary. Each Supplier is independent and responsible for its own acts/omissions. We are not liable for Supplier negligence or events beyond our reasonable control, subject to applicable law and these T&Cs.

3) Quotes, Pricing, What’s Included / Excluded

Prices are per-person, typically based on double occupancy unless noted, and may be shown in USD (or the currency on your invoice).
Included items appear on your itinerary/invoice (e.g., specified accommodations; scheduled ground transfers; activities and guiding per itinerary; park fees listed as included; listed meals; basic baggage handling; taxes where indicated).
Not Included unless specified: international or regional airfare; unscheduled transfers; visas; vaccinations/medical costs; travel insurance; gratuities if not listed; beverages and personal expenses; optional activities/upgrades; laundry; excess baggage; any item not expressly listed as included.

4) Booking, Deposit & Final Payment

  1. a) Deposit (non-refundable): Due at booking to secure space—[insert IntelSafari policy, e.g., 25% of Trip price or USD $____].
    b) Final Balance: Due [insert window, e.g., 60 days] before Departure Date (or the date shown on invoice).
    c) Late/Non-Payment: If we do not receive full payment by the due date, we may treat the booking as canceled and apply cancellation fees below.
    d) Payment Methods: As indicated on invoice (e.g., card, wire). Client pays bank/card fees and any currency conversion costs.

5) Client Changes (Post-Confirmation)

We’ll try to accommodate reasonable changes (dates, room types, extensions). Change fees and price differences may apply. Changes requested inside cancellation windows may be treated as cancellations (see §7).

6) Names, Documents & Special Requests

You must provide full legal names matching passports and disclose special requests (dietary, mobility, medical, bedding, rooming) before booking. We will forward requests to Suppliers but cannot guarantee fulfillment.

7) Client Cancellation & Refunds

If you cancel, you must notify info@intelsafari.com in writing from the lead traveler’s email. The cancellation is effective on our written acknowledgment.

Standard Schedule (unless your invoice states otherwise):

  • Unrecoverable Costs (e.g., flights, permits, special events, single-supplements, special-order services) are non-refundable and deducted from any refund/credit.
  • After travel commences, no refunds for unused services (missed nights, activities, flights).
  • Refunds are processed to the original payment method (where possible) within [e.g., 30 days] of approval and may be net of third-party fees.

You are strongly encouraged (and in certain destinations required by IntelSafari) to carry comprehensive travel insurance including cancellation, interruption, medical, and evacuation.

8) Cancellation/Changes by IntelSafari

We may modify or cancel a Trip for safety, logistics, or operational reasons.

  • Before Departure (not force majeure or Client breach): your choice of (i) full refund of monies paid (less Unrecoverable Costs), or (ii) future travel credit of [e.g., 110%] valid for [e.g., 24 months] on IntelSafari trips.
  • Significant Changes (major itinerary or accommodation downgrade): you may accept, select a substitute Trip (paying any difference), or cancel per the line above.
  • After Departure: any refund/credit is pro-rata for unused services, less Unrecoverable Costs.
  • Force Majeure: We may provide reasonable assistance and, where possible, credits toward future travel, subject to Supplier terms.

9) Health, Fitness & Assumption of Risk

Travel—particularly wildlife and remote-area travel—carries inherent risks (terrain, weather, wildlife encounters, remoteness, transportation). You accept these risks. You must be fit to travel, follow safety instructions, and disclose relevant health/mobility conditions in advance. We may decline service if a condition poses safety or operational concerns.

10) Visas, Passports & Travel Advisories

You are responsible for valid passports, visas, permits, vaccinations, and compliance with entry/exit, health, and customs rules. We recommend reviewing U.S. Department of State Travel Advisories and enrolling in STEP prior to departure. Travel+2State Department+2

11) Baggage, Personal Effects & Valuables

Airlines and local carriers impose baggage limits. You are responsible for securing valuables. IntelSafari is not responsible for loss/damage to baggage/personal effects except as required by law.

12) Wildlife, Seasons & Photography

Wildlife sightings and natural phenomena can never be guaranteed. Photos and descriptions are illustrative; actual conditions vary by season and weather.

13) Supplier Terms

Supplier terms (airlines, lodges, activity operators, rail, cruise, charter) apply and may control in case of conflict. We can provide copies on request. Any refunds are limited to amounts we can recover from Suppliers, consistent with these T&Cs.

14) Responsibility, Limits & Indemnity

To the fullest extent permitted by law:

  • IntelSafari’s aggregate liability is limited to the greater of (i) amounts paid to us for the portion of services giving rise to the claim, or (ii) USD $1,000.
  • We are not liable for indirect, incidental, special, punitive, or consequential losses (e.g., lost enjoyment, missed connections, additional travel costs), or for acts/omissions of Suppliers or events beyond our control.
  • You agree to indemnify and hold IntelSafari harmless from claims and expenses (incl. reasonable attorneys’ fees) arising from your breach, willful misconduct, or negligent acts.

(If your Website ToS already contains a broader limitation, ensure the two are consistent.)

15) Insurance Requirement & Medical Care

You acknowledge that comprehensive travel insurance is strongly recommended and may be required for certain Trips/destinations (including medical and evacuation). Medical facilities and standards vary; costs are your responsibility.

16) Complaints & Claims Notice Period

Please notify your guide/host immediately so we can attempt to remedy issues in real time. For claims after your Trip, send written details to info@intelsafari.com within [e.g., 30 days] of return; failure to give timely notice may affect our ability to investigate and your remedies.

17) Image, Testimonial & Likeness

Where legally permissible, and unless you opt out in writing in advance, you grant IntelSafari a non-exclusive, royalty-free license to use Trip photos/testimonials that you share with us (or tag with IntelSafari identifiers) for promotional/editorial purposes.

18) Privacy

We process personal information per our Privacy Policy (collection, use, sharing, transfers, data rights). Your Trip may require sharing data with Suppliers (lodges, transport, activity operators) and border agencies. California/Colorado/EEA/UK residents may have additional rights. We honor Global Privacy Control (GPC) opt-out signals for sale/sharing (California) and Universal Opt-Out Mechanisms for targeted ads (Colorado). 19) Governing Law; Arbitration; Venue; No Class Actions

These T&Cs are governed by U.S. federal law and the laws of New Mexico, U.S.A. (without regard to conflicts-of-law rules).

Binding Arbitration. Except for eligible small-claims matters, any dispute arising out of or relating to these T&Cs or your Trip shall be resolved by final, binding arbitration on an individual basis under the American Arbitration Association (AAA) Consumer Arbitration Rules (as amended), before a single neutral arbitrator. The award may be entered in any court with jurisdiction. Proceedings may be conducted by teleconference/videoconference unless the arbitrator determines an in-person hearing is warranted; any in-person hearing will take place in Bernalillo County, New Mexico. Nothing prevents you from raising issues with government agencies.

20) DMCA (User-Submitted Materials)

If you believe user content we host infringes your copyright, you may submit a notice under 17 U.S.C. §512 to our designated agent (see our Privacy/Security page for details). Counter-notices are permitted where applicable. U.S. Copyright Office+2Legal Information Institute+2

21) Miscellaneous

  • Entire Agreement: These T&Cs, your itinerary/invoice, and any written special conditions comprise the entire traveler contract.
  • Severability: If any provision is invalid, the remainder remains effective.
  • Assignment: You may not assign without our consent; we may assign as permitted by law.
  • Notices: By email to info@intelsafari.com unless another address is specified in your documents.
